Terms & Conditions
These Terms and Conditions ("Terms") govern your access to and use of Stackorithm.com, our mobile and web apps, and related services (collectively, the "Services"). By creating an account or using the Services you agree to these Terms. If you do not agree, do not use Stackorithm.
1. Who We Are
Stackorithm.com is owned and operated by an entity based in Ontario, Canada ("Stackorithm", "we", "us"). The Services are offered globally, subject to local laws. You are responsible for ensuring that use of the Services complies with laws that apply to you.
2. Eligibility and Accounts
You must provide accurate account details and maintain the security of your credentials. Stackorithm does not impose a formal age restriction, but if you are under the age of majority in your jurisdiction you must have permission from a parent or legal guardian. You are responsible for all activity under your account.
3. Service Features and Disclaimers
Stackorithm offers AI-assisted recipe generation, meal planning, nutritional estimates, and community content. Nutritional values are estimates only; ingredients and instructions are informational and may not reflect your dietary needs or allergies. Public recipes are provided by their respective creators. AI-generated recipes will display "Kichmate AI" as the author name. Always verify ingredients, allergens, and preparation steps independently. Stackorithm is not responsible for adverse reactions or outcomes.
4. Subscriptions, Billing, and Refunds
- Paid plans auto-renew unless you cancel through your account settings.
- Payments are processed by third-party providers (for example Stripe or similar). Their own terms may apply.
- All fees are non-refundable. Cancellation stops future charges at the next billing period; previously paid amounts are not refunded.
- You authorize Stackorithm to charge applicable taxes or regulatory fees where required.
5. User-Generated Content
You retain ownership of recipes, photos, comments, and other content ("User Content") you submit. By uploading or creating User Content you grant Stackorithm a worldwide, royalty-free, transferable license to host, store, display, reproduce, translate, analyze, moderate, and create derivative insights from that content for the purpose of operating, improving, and promoting the Services. You can choose whether your recipes are public or private. We may remove or refuse any content that violates these Terms or appears harmful.
You represent that you have the rights to submit the content and that it does not infringe intellectual property, privacy, or publicity rights of others.
6. Acceptable Use
You agree not to:
- Upload defamatory, obscene, hateful, or otherwise offensive content.
- Post recipes that are fraudulent, dangerous, or intentionally misleading.
- Scrape, crawl, or harvest data without our written consent.
- Reverse engineer or interfere with security features of the Services.
- Use the Services for commercial resale, spam, or unauthorized advertising.
7. Third-Party Services and Integrations
The Services rely on third-party providers (AI platforms such as OpenAI, analytics tools, hosting, payment processors). Use of those providers may be subject to their own terms. Stackorithm is not responsible for third-party content or services outside our reasonable control, but we expect partners to safeguard user information consistent with our Privacy Policy.
8. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create risk, or engage in suspected fraud. You may delete your account at any time via the in-app request form. Certain provisions (ownership, disclaimers, liability limits, dispute resolution) survive termination.
9. Warranty Disclaimer
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee uninterrupted or error-free operation, nor that recipes or nutritional data will meet your expectations.
10. Limitation of Liability
To the maximum extent permitted by law, Stackorithm and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the Services. Our total liability for any claim is limited to the greater of (a) the amount you paid to Stackorithm in the one (1) month preceding the event giving rise to the claim, or (b) CAD $0 for users on free tiers.
11. Indemnification
You agree to defend, indemnify, and hold harmless Stackorithm and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising out of your User Content, your use of the Services, or your violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the courts located in Ontario for any dispute or claim. To the extent permitted by law, you waive participation in class actions or jury trials against Stackorithm. Each dispute must be brought in an individual capacity.
13. Assignment
Stackorithm may assign or transfer these Terms (in whole or part) in connection with a merger, acquisition, financing, or sale of assets. You may not assign your rights or obligations without our prior written consent, and any unauthorized assignment is void.
14. Changes to These Terms
We may update the Terms from time to time. We will post the revised Terms and notify you via email or in-app notice before changes take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
