Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of Kitchmate.com, our mobile and web apps, and related services (collectively, the "Services"). By creating an account or using the Services you agree to these Terms. If you do not agree, do not use Kitchmate.

1. Who We Are

Kitchmate.com is owned and operated by an entity based in Ontario, Canada ("Kitchmate", "we", "us"). The Services are offered globally, subject to local laws. You are responsible for ensuring that your use of the Services complies with all laws that apply to you in your jurisdiction.

2. Eligibility and Accounts

You must provide accurate account details and maintain the security of your credentials. Kitchmate does not impose a formal minimum age, but if you are under the age of majority in your jurisdiction you must have permission from a parent or legal guardian. You are responsible for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized access.

3. Service Features and Disclaimers

Kitchmate offers AI-assisted recipe generation, meal planning, nutritional estimates, pantry tracking, party and event planning, community content, and related cooking tools. Nutritional values are estimates only; ingredients and instructions are informational and may not reflect your individual dietary needs, allergies, or health conditions. Public recipes are provided by their respective creators. AI-generated recipes will display "Kitchmate AI" as the author name. Always verify ingredients, allergens, cooking temperatures, and preparation steps independently before consuming or serving any dish. Kitchmate is not responsible for adverse reactions, injury, or outcomes resulting from use of the Services.

4. Subscriptions, Billing, and Refunds

  • Paid plans auto-renew at the end of each billing period unless you cancel through your account settings before the renewal date.
  • Payments are processed by third-party providers (for example Stripe or similar). Their own terms and privacy policies apply to payment data.
  • All fees are non-refundable unless required by applicable law. Cancellation stops future charges at the start of the next billing period; previously paid amounts are not refunded.
  • You authorize Kitchmate to charge applicable taxes, currency conversion fees, or regulatory levies where required by law.
  • We reserve the right to modify pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

5. User-Generated Content

You retain ownership of recipes, photos, comments, meal plans, party details, and other content ("User Content") you submit. By uploading or creating User Content you grant Kitchmate a worldwide, royalty-free, sublicensable, transferable license to host, store, display, reproduce, translate, analyze, moderate, and create derivative insights from that content for the purpose of operating, improving, and promoting the Services. You can choose whether your recipes are public or private. We may remove or refuse any content that violates these Terms or appears harmful.

You represent that you have the necessary rights to submit the content and that it does not infringe the intellectual property, privacy, or publicity rights of any third party.

6. Acceptable Use

You agree not to:

  • Upload defamatory, obscene, hateful, or otherwise offensive content.
  • Post recipes that are fraudulent, dangerous, or intentionally misleading (for example, content designed to cause harm through incorrect allergen information).
  • Scrape, crawl, or systematically harvest data from the Services without our prior written consent.
  • Reverse engineer, decompile, or interfere with security features or infrastructure of the Services.
  • Use the Services for commercial resale, spam, phishing, or unauthorized advertising.
  • Attempt to gain unauthorized access to other users' accounts or our backend systems.
  • Use automated tools to generate large volumes of content in a manner that degrades performance for other users.

7. Third-Party Services and Integrations

The Services rely on and may integrate with a range of third-party providers to deliver features. These currently include, and may in the future include:

  • AI providers (such as OpenAI and similar large language model providers) for recipe generation and smart suggestions.
  • Infrastructure and database providers (such as Vercel for hosting and Supabase for database, authentication, and storage).
  • Payment processors (such as Stripe or similar) for subscription management and billing.
  • Email delivery providers (such as Resend or similar) for transactional and notification emails.
  • External content APIs (such as the YouTube Data API) for recipe import and metadata retrieval.
  • Analytics and monitoring tools (such as PostHog, Mixpanel, Sentry, or similar) for usage insights and error tracking.
  • Cloud storage and media delivery for hosting user-uploaded images and assets.

Use of third-party integrations may be subject to those providers' own terms of service and privacy policies. Kitchmate is not responsible for third-party content, services, or outages outside our reasonable control, but we select partners who meet appropriate data protection and security standards.

8. Intellectual Property

The Kitchmate name, logo, design, software, and platform — excluding User Content — are the intellectual property of Kitchmate and its licensors. Nothing in these Terms grants you a license to use our brand assets, trademarks, or proprietary technology beyond what is necessary to use the Services as intended. Feedback, ideas, or suggestions you provide may be used by us without obligation or compensation to you.

9. Suspension and Termination

We may suspend or terminate your access if you violate these Terms, create risk for other users, or engage in suspected fraud or abuse. You may delete your account at any time via the in-app request form. Upon termination, your right to use the Services ends; however, certain provisions (including intellectual property, disclaimers, liability limits, indemnification, and dispute resolution) survive termination.

10. Warranty Disclaimer

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee uninterrupted or error-free operation, nor that AI-generated recipes, nutritional data, or meal plans will meet your specific dietary needs or expectations. Feature availability may change over time as the product evolves.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Kitchmate and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from or related to your use of or inability to use the Services. Our total aggregate liability for any claim arising from or related to these Terms or the Services is limited to the greater of (a) the amounts you actually paid to Kitchmate in the one (1) month preceding the event giving rise to the claim, or (b) CAD $0 for users on free tiers.

12. Indemnification

You agree to defend, indemnify, and hold harmless Kitchmate and its affiliates, officers, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use or misuse of the Services, or your violation of these Terms or any applicable law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute or claim arising from or related to these Terms or the Services. To the extent permitted by applicable law, you waive any right to participate in class actions or class-wide arbitration against Kitchmate. Each dispute must be brought individually.

14. Assignment

Kitchmate may assign or transfer these Terms (in whole or in part) in connection with a merger, acquisition, financing, reorganization, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent, and any purported unauthorized assignment is void.

15. Changes to These Terms

We may update these Terms from time to time as the Services evolve or as legal requirements change. We will post the revised Terms on this page and notify you via email or in-app notice at least 14 days before material changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.
